VENDOR TERMS AND CONDITIONS 
Your submission of an application binds you to the terms below.
 
Submission is not a guarantee of acceptance, as this is a juried event.
We reserve the right to refuse any application without explanation. 
Please review these terms carefully as we expect you to adhere to them without limitation.
 
All rules and regulations will be fairly, strictly and unilaterally enforced by the New Braunfels Heritage Foundation Event Committee.
 
Your full cooperation will be appreciated.
 
VENDOR TYPES
Merchandise Vendor - a merchandise vendor is any vendor that is not required to obtain a permit from the local health department to do business, this includes vendors that fall under the Texas Cottage Law and whose items are prepackage and labeled. To maintain the integrity of the market’s vision all items must handmade or directly imported from Europe. Direct Sales or Direct Marketing vendors such as Mary Kay, Avon, Scentsy, Country Candles, LipSense or SeneGence® products, dōTERRA, Young Living Essential Oils, ColorStreet, Jamberry, etc., are not eligible to participate in this event.

Food Vendor – a food vendor is any vendor (Texas Cottage Law or Caterer) that serves non prepackaged and labeled food/drink and is required to obtain a permit from the local health department.

RULES AND REGULATIONS
This event is presented by the New Braunfels Heritage Foundation, hereinafter NBHF. The NBHF Event Committee will have final authority in the manner of interpretation and enforcement of all rules and regulations related to the event, and reserve the right to accept or reject any application of exhibit space at its sole discretion. 
Please read these rules carefully.
 
VENDOR VOLUNTEERING
Each vendor is required to Volunteer a minimum of 5 hours or pay a fee of $20.00 per hour to allow the NBHF to hire help in leu of the vendors volunteer hours.
 
These hours can be done pre or post event, it's your choice.
 
SMOKING AND VAPING
Smoking and vaping are prohibited on the event grounds.
 
PETS AND SERVICE ANIMALS
Please not that only trained service animals are allowed on the event grounds, due to the crowded and stimulating environment and potential health and safety risk to both the animal and or other event attendees.
 
INSURANCE
All vendors must provide proof of liability insurance, in the amount of $1,000,000.00, along with proof of New Braunfels Heritage Foundation and Schlitterbahn Resort being listed as additionally insured.

If you have a brick and motor business your business existing liability policy should extend coverage outside of your business. Ask your insurance company to add New Braunfels Heritage Foundation and Schlitterbahn Resort as additionally insured.
 
SALES TAX
Proof of SALES TAX IDENTIFICATION NUMBER is required. A compliance visit from the State Comptroller’s Office can be expected during the event.
 
Vendors are solely responsible for the reporting and payment of all sales/use tax applicable to your sales.

FIRE SAFETY
All booths are subject to inspection by the Fire Marshall and must have a readily accessible 1-A:10-B:C rated fire extinguisher. Food vendors must have a Class K rated fire extinguisher with a current service tag.
 
NO exceptions.
 
BOOTHS
Trucks and Trailers are strictly prohibited at this event.
 
Each vendor must decorate their tent with a facade to mimic the appearance of a building, covering ALL working sides of the tent. This is mandatory, NO exceptions.

Booths must also be decorated in a Christmas theme. The NBHF will not provide decorations.
 
Each booth space is 10 x 10; tents, weights, tables, chairs, display units, covers, etc. and are the responsibility of each vendor. The NBHF will not provide tents, weights, tables, chairs, display units, covers, signs, or additional equipment.
 
Booths must be properly weighed, with a minimum of 36 lbs. per tent leg, weights must be attached to your booth. The NBHF will not provide weights.
 
Booths must be confined to the space you rent. This includes awnings, signs, product, tables, chairs, etc. Exhibits may not interfere with other exhibits or impede access to them or impede the use of the walkway (this includes roaming, passing out tickets or giving away samples. You must stick to the general area of your booth and respect the space of other vendors. No roaming the grounds distributing anything). This will be strictly enforced.
 
There will be no early take-downs. All vendors agree to remain for the entire event. Early closings and/or take-down will harm the reputation of the event and its vendors, and will not be allowed. This may result in not being invited back in subsequent years.
Booths and locations are assigned by the NBHF Event Committee.
 
ELECTRICITY
Electricity is in addition to your booth fee, and is due when booth fees are due.
 
Electrical heaters are not allowed unless you have a dedicated or additional outlet for the heater ONLY.
 
DO NOT PLUG ANYTHING INTO EVENT ELECTRICITY until you are told to do so.
 
Each 110 outlet is for no more than 20 amps of service. All extension cords must be #12 wire. 

If you are caught using electricity that was not paid for, you will be charged 2x the normal rate and shut down until fees are paid.
 
PARKING
There is one designated parking lot for vendors, it is first come, first serve. Trailers are not allowed to occupy this lot. There is plenty of parking surrounding the event grounds. Once unloaded, vendors must move vehicles to a parking lot. No vehicles are allowed to remain on the event grounds.
 
LICENSES AND PERMITS
Each food and drink vendors must comply with applicable health requirements. All food and drink vendors must hold a current catering license and obtain a temporary food permit from the New Braunfels Environmental Health Department.

ELIGIBILITY AND PROHIBITED ITEMS
Items of questionable taste or items that do not reflect the high standards of the NBHF Event Committee are prohibited.
 
Soda, Water, Wine and Beer Rights Are Reserved.

Additionally, the following items are strictly prohibited:
 
-any items that may violate Federal, State or local laws.
 
-CDB products.
 
-the sale of live animals.
 
-all firearms, accessories and kits, air soft guns, toy guns or other items that release a projectile.
 
-any restraint devices, clubs, blackjacks, and other items designed and marketed for police use.
 
-swords, daggers, switchblade knives.
 
-chemical defense items, paint ball
guns and supplies, darts, stun guns, and martial art weapons.
 
-pornographic material and literature, or sexually oriented items and literature.
 
-unlicensed fan art.
 
Violators will be subject to immediate removal without refund of fees.
